ARTICLE 2- CONTRACT SUBJECT

This distance sales agreement (hereafter referred to as the “Agreement”) relates to the determination of rights and obligations between the buyer and the seller party in accordance with the provisions of the Consumer Protection Act No. 6502 regarding the sale of the service specified below, which the buyer wishes to purchase via the seller’s internet address.


ARTICLE 3-CONTRACTUAL FEATURES, PRICE AND PAYMENT OF THE SERVICE

3.1- The specifications of the service subject to the contract are as follows:

3.2- The contract price is agreed by the parties to be 0.00 (______ dollars) including all taxes. The receiving party must pay the agreed price within 7 days. Otherwise, the obligation of the seller to perform the agreed service will be eliminated.

ARTICLE 4- THE PLACE OF EXECUTION AND DELIVERY OF THE CONTRACT

It is accepted that the contract comes into force with the approval of the buyer. By performing the service purchased by the buyer from the seller, the seller fulfills his debt.

ARTICLE 5-COSTS RELATED TO THE EXECUTION OF THE SERVICE

The costs related to the performance of the service subject to the contract belong to the seller. The performance of the contract is carried out by the seller within a maximum of ___ days, with the  buyer paying the contract price  to the seller. If the buyer has not paid the agreed price within 7 days of the contract being signed, the performance burden of the seller will be eliminated.

ARTICLE 7-FORCE MAJEURE

Situations that do not exist or are not foreseeable at the time of signing of the Contract, which develop outside the control of the parties, whose emergence prevents one or both parties from fulfilling their debts and responsibilities imposed by the contract in whole or in part, or to fulfill them at the agreed time, are considered force majeure. In the event of force majeure (natural disaster, war, terrorism, uprising, changing legislation provisions, seizure, strike, lockout, significant failure of production facilities), the party that cannot perform the contractual debt due to force majeure will immediately notify the other party.


ARTICLE 8-DISPUTE RESOLUTION

In order to resolve disputes arising from this contract, until the value declared by the Ministry of Customs and Trade, the Consumer Arbitral Tribunal at the place where the buyer purchases the service or where the seller’s residence is located, and the Consumer Courts are authorized in disputes whose price is outside the value determined by the Ministry. In accordance with the lower and upper limits specified in accordance with Article 68 of the Consumer Protection Law No. 6502, the district or provincial consumer arbitration committees are authorized about consumer demands.
